1. Scope and Preamble

These General Terms of Service (Conditions Générales de Vente et d'Utilisation) govern all floral commissions, product acquisitions, concierge engagements, and website visits facilitated through Zippycornerfeedbrst.lat, operated by Zippycornerfeedbrst Florale SAS (RCS Paris B 892 411 730), located at 28 Rue du Faubourg Saint-Honoré, 75008 Paris. By submitting an inquiry, commissioning an arrangement, or finalizing an order, you agree to be bound unconditionally by these terms.

2. Nature of Perishable Botanical Creations

The client acknowledges that fresh flowers, foliage, and living botanical specimens are organic, perishable materials subject to seasonal harvesting variations, climatic shifts, and individual stem variances. Photographs displayed in our compendium represent true atelier work; however, each seasonal bouquet is an unrepeatable work of craftsmanship.

In instances where a specific cultivar (such as a particular shade of Centifolia rose or early-season peony) is unavailable due to dawn market supply or weather events, our floral masters maintain the artistic discretion to substitute stems of equal or superior monetary value and aesthetic standing, preserving the designated palette and architecture.

3. Delivery Protocols and Recipient Availability

Due to the delicate nature of luxury flowers, our deliveries throughout Paris and adjacent departments are executed via dedicated temperature-regulated vehicles or white-glove foot couriers:

  • Access Information: The ordering client is solely responsible for providing precise delivery information, including full recipient name, working door intercom codes (digicode), floor numbers, concierge instructions, and direct telephone numbers.
  • Absence of Recipient: If the recipient is absent upon courier arrival, the courier will attempt to leave the protected arrangement with a building concierge (gardien) or secure neighbor, leaving a physical calling card and digital notification. If no secure alternative exists, the order returns to our Faubourg Saint-Honoré atelier. A secondary redelivery incurs an additional €25 dispatch charge.

4. Exemption from Right of Withdrawal

Pursuant to Article L221-28 4° of the French Consumer Code (Code de la consommation), the statutory fourteen-day right of withdrawal for remote purchases does not apply to contracts for the supply of goods that are liable to deteriorate or expire rapidly. Freshly cut bouquets, floral installations, and customized botanical creations are therefore strictly non-returnable and non-refundable once crafted and dispatched.

5. Intellectual Property

All creative designs, photographs, architectural installation drawings, textual descriptions, logos, graphics, and branding assets showcased on Zippycornerfeedbrst.lat are the exclusive intellectual property of Zippycornerfeedbrst Florale SAS, protected under French and international intellectual property law. Any unauthorized reproduction, framing, or commercial exploitation is strictly prohibited without prior written license.

6. Limitation of Liability

Zippycornerfeedbrst Florale SAS shall not be held liable for delayed delivery resulting from events of Force Majeure as defined by Article 1218 of the French Civil Code (including severe meteorological disruptions, transport blockades, civil demonstrations, or security cordons around Paris diplomatic sectors). Our aggregate financial liability in connection with any floral commission is strictly capped at the total amount invoiced and paid for the specific order under question.

7. Governing Law and Dispute Resolution

These Terms of Service are governed exclusively by and construed in accordance with French law. In the event of a dispute, clients are encouraged to contact our concierge to seek an amicable resolution. In the absence of an amicable settlement, consumer clients may access consumer mediation via the Paris Mediation Centre (Centre de Médiation et d'Arbitrage de Paris - CMAP). Any judicial proceedings shall be brought exclusively before the competent courts within the jurisdiction of the Paris Court of Appeal (Cour d'Appel de Paris).
